License to use Yandex Search Engine

1. General Provisions

1.1. Yandex (as referred in User Agreement for Yandex Services https://yandex.com/legal/rules/) offers an Internet user (the “User”) to use the Yandex Search Engine for searching information posted on the Internet according to their interest. The service is available at: https://www.yandex.com (the “Service”).

1.2. The use of the Service is governed by these Terms and the following Governing Documents: Yandex Services User Agreement (https://yandex.com/legal/rules), the Privacy Policy (https://yandex.com/legal/confidential).

1.3. By starting to use the Service/certain functions thereof, the User shall be deemed to have accepted these Terms and terms of all of the above documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Service.

1.4. Yandex may amend these Terms without any special notice; revised Terms shall come into effect once posted online at the URL specified in this paragraph, unless otherwise stipulated in revised Terms. The current version of the Terms shall always be available at: https://yandex.com/legal/termsofuse.

1.5. If Yandex has made any amendments to these Terms according to the procedure specified in Clause 1.4 hereof, and the User disagrees with these amendments, the User shall cease using the Service.

1.6. All currently available functions of the Service along with any developments and/or newly added functions shall be subject to these Terms. Some functions of the Service, decsribed in these Terms, may not be accessible to the User depending on the region in which the Service is provided.

1.7. In compliance with Regulation (EU) 2022/2065 (DSA), Yandex discloses the average monthly active users of the Service in the European Union, as defined in Article 24(2) of the DSA.

For the six-month period ending December 2024, there was 3.5 million average monthly active users of the Service in the EU. Statistics for the previous reporting periods is available at https://yandex.com/legal/termsofuse_mau.

2. Websites Indexing

2.1. Yandex shall index website pages created by third parties. Yandex indexes pages of websites that are publicly available on the Internet, i.e. the pages that are accessible when clicking on a link, without entering a username and password, and indexing of which is not prohibited in robots.txt of the corresponding website (more information is available at: https://yandex.com/support/webmaster/en/controlling-robot/robots-txt.html).

If the site owner wants to establish indexing settings or restrict pages from indexing, he can use the instructions on the page https://yandex.com/support/webmaster/en/adding-site/indexing-prohibition.html.

Information about the search robots used by Yandex is published on the page https://yandex.com/support/webmaster/en/robot-workings/check-yandex-robots.html.

2.2. Changes on the website pages shall be tracked by the Yandex robot in automatic mode (reindexing shall also be performed) in order to update the search results. Any information and materials posted on the pages of third-party websites may be changed at any time by the particular page owner. Yandex shall not track such changes for each of the websites and shall be not responsible for that.

2.3. Yandex independently determines the process of site indexing by robot, the order of page updates, search robot settings. Yandex may independently decide which website will and which will not be included in the Service database.

2.4. The result ordering, as part of the indexing and search process, shall be fully automatic in accordance with the established relevance criteria, which may be changed to improve the quality of the search at the discretion of Yandex. Yandex gives to the relevance the meaning of the best match of search results for a specific query to the interests of Users looking for information, which may generally not coincide with the interests of website owners or individual Users. The search results page may contain advertisements accompanied by special marks or external design that allow you to distinguish the ads from the search results displayed on the page.

2.5. Yandex will not manipulate the website positions in the search results of the Service for any User queries (keywords), it never sells such positions to anyone and does not guarantee the immutability of the position of a particular website in the search results for a specific User query.

2.6. Search spam is an attempt to deceive the Service's search engine and manipulate its results in order to change the particular website position in search results. Websites using “search spam” may be downgraded during ranking or excluded from the Service database due to the impossibility of their correct ranking.

2.7. Yandex will not comment on the exclusion of websites from the Service database and/or the change of their position, will not notify of such actions, and does not give any guarantees or set deadlines for their re-inclusion in the Service database/change of their position.

2.8. Yandex may not provide an exhaustive list of search spam methods that may cause the website exclusion from the Service database and/or a change in its position. 3. Use of the Service. Certain Functions of the Service

3.1. Yandex provides the User with the opportunity to search for information on the Internet according to the search query specified by the User. The Service shall be provided to the User free of charge and shall be intended exclusively for personal, non-commercial use.

3.2. The search results may contain information blocks with rich answers designed to present information in the most user-friendly format.

These information blocks may be presented as a digest (a quick response to a User's search query in the line for a search query), or as a block anywhere on the page vacant from search results, or otherwise, in compliance with the rules established by this clause.

Such blocks on the search results page shall be separated from the search results: using the differences in the design of a such block or the output or by means of the location of the block outside the output, or by other means.

The rich answers shall be based on the Yandex search database and also may be placed by Yandex automatically using information obtained from open sources, as well as received from Yandex services.

The information provided in the rich answers shall be for reference only. The Service functionality shall not be intended to be used for the purpose of establishing legally significant facts, promoting in search results, expressing an objective rating of the information provided and other purposes. Any information contained in the rich answers shall require a doublecheck on the page of the source of such information.

Yandex shall not be responsible for the rich answers content, neither for the accuracy, reliability, relevance, compliance with legislation and completeness of the information provided, nor for any consequences of its use by the User.

The User may complain about the information in the information block of the search results by filling out the appropriate form on the page: https://yandex.com/support/abuse/en/troubleshooting/search/search-appearance.html, or quickly report a problem through the tools available directly in the information block.

Interactive search elements will not affect the operation of automated search algorithms functioning without manual involvement and may not be qualified as a tool for allocating any priorities or advantages to the websites when ranking search results.

3.3. Search results may contain an answer prepared using the “Neuro” mode.

In the "Neuro" mode, the User can receive an answer to his search query generated from several search results sources for such a query. The responses in the "Neuro" mode are generated automatically using artificial intelligence technologies.

Yandex cannot guarantee the accuracy, relevance, correctness, sufficiency and completeness of the information provided, cannot guarantee that the response meets the User's expectations and goals, and is not responsible for the content of the response generated in the "Neuro" mode. The User undertakes to independently verify the correctness and relevance of the information provided in such response, as well as to doublecheck the information with the source sites. The response generated in the "Neuro" mode is not an expression of anyone's opinion, Yandex's position, or a statement of facts and cannot under any circumstances be regarded as guidance or advice when making decisions or performing any actions.

The User is solely responsible for the compliance of the searching request with the legislation, and also assumes all risks, including those related to the violation of the rights of third parties, when using the Neuro answer.

If a low-quality response is detected, or a response containing, in the user's opinion, incorrect or illegal information, the user has the opportunity to report this through the feedback form available in the interface.

3.4. The user can independently set the search parameters, including selecting the family search mode, which filters adult content from the search results.

Filtering technologies operate automatically and cannot guarantee the complete removal of information that is inappropriate for minors from the search results. The activation of the family mode does not relieve parents of their responsibility to monitor their children's use of the service.

3.5. Yandex reserves the right not to process queries from any Users, websites or programs that violate the terms hereof.

3.6. Yandex does not guarantee that the response to the search query will be exhaustive and that the User will receive all the information available on the Internet on the topic of interest, or for the absolute accuracy, or relevance of links to the pages of websites presented in the search results of the Service for a specific User query.

4. Limitation of liability

4.1. Yandex is not involved in the use, modifying, posting or distribution of any information or materials contained on third-party websites, and does not provide access to such materials. Yandex does not make available and does not host any of these sites (or materials posted on them) on its own servers.

4.2. Yandex shall not be liable for the quality and content of indexed pages. Indexation is performed automatically using certain algorithms that do not imply any prior or subsequent evaluation of website content (moderation) regarding its compliance thereof with legal, ethical or moral requirements, as well as any censorship.

4.3. The User uses the Service at his own risk. The Service is provided as is. Yandex bears no responsibility for User’s exploitation of the Service, as well as for meeting the User's goals by the Service functionality.

Yandex does not guarantee that the Service complies with User's requirements; that the Service will be provided without interruptions, promptly, sustainably and without errors; that results received with the use of the Service are accurate and reliable and may be used for any purposes or in any capacity (for instance, for identification or verification of any facts).

4.4. Any information or materials which the User accesses through the Service may be used by the User at his own risk and the User shall be responsible for any potential consequences of the use of such information or materials. Yandex shall not be liable for any losses resulting from the User using the Service or its functionality.

5. Confidentiality and Privacy. Other Provisions

5.1. The relationship between the User and Yandex with respect to all information that Yandex may receive about the User while using the Service shall be governed by the Privacy Policy (https://yandex.com/legal/confidential).

5.2. This Terms and Governing Documents shall be regulated and interpreted according to applicable laws.

5.3. If for any reasons one or several provisions of this Terms are declared invalid or unenforceable, it shall not affect the validity or enforceability of the remaining provisions hereof.

5.4. Failure by Yandex to act in case of violation by the User or any other users of the provisions of the Terms shall not deprive Yandex of the right to take action to protect its interests in the future and shall not be interpreted as waiver by Yandex of its rights in case of any future similar or identical violations.

Yandex reserves the right to contact the applicant to clarify the information or to obtain confirmation of the grounds of the complaint.
