Yandex Maps Program License Agreement

Before using the program, please, read the terms of the license agreement below.

Any use of the program means your full and unconditional acceptance of the terms of this license agreement.

If you disagree with any of the terms of the license agreement in full, you may not use the program for any purposes.

1. General Terms

1.1. “Yandex Maps Program License Agreement” (hereinafter referred to as the “License”) sets the terms of using the Yandex Maps Program (hereinafter referred to as the “Program”) and is concluded between any person using the Program (hereinafter referred to as the “User”) and Büyük Reklam Çözümleri Limited Şirketi, the owner of the exclusive right to the Program (hereinafter referred to as the “Right Holder”).

1.2. By installing it on his/her device or otherwise using the Program, the User acknowledges that he has read, understood, and agreed to be bound by these terms of the License and the License is deemed to be concluded.

1.3. The Program may only be used under the terms of this License. If the User does not fully accept the terms of the License, the User may not use the Program for any purposes. Using the Program in violation of (without meeting) any of the terms hereof is prohibited. The Program can be used by Users with legal capacity in accordance with the applicable laws. If the User does not have the legal capacity under the applicable laws, they may not use the Program.

1.4. The User’s use of the Program on the terms of this License for personal non-commercial purposes is free of charge. Any use of the Program in a manner not provided by this License requires a separate agreement with the Right Holder.

1.5. The use of the Program by the User shall be governed by the following documents, the terms of which are fully applicable to the Program's use and constitute integral parts of this License:

These documents (including any parts thereof) may be unilaterally amended by the Right Holder without any prior notice. Revised versions of the documents will enter into force upon publication unless otherwise stated in the revised versions

1.6. This License and all relations connected with the use of the Program will be governed by the laws of the Republic of Türkiye**.** Any claims or lawsuits arising from this License or use of the Program shall be subject to the exclusive jurisdiction of the Istanbul (Çağlayan) Courts and Execution Offices.

1.7. The Right Holder may furnish to the User a translation of this License from English into other languages. However, in case of any conflict between the English version and its translations, the English version of the License will prevail and have legal effect.

1.8. The functions of the Program can be restricted, subject to the operation system of User’s device.

1.9. All or some functions of the Program can be unavailable or limited depending on the User’s region. Functions are deemed unavailable (limited) if the User cannot explicitly use them in their region. It is prohibited to use any technical and software-based methods to circumvent these limitations.

2. Rights to the Program

2.1. The exclusive right to the Program belongs to the Right Holder.

3. License

3.1. The Right Holder furnishes the User for no compensation with a non-transferable right to use the Program worldwide, under the terms of a non-exclusive license, as follows:

3.1.1. To use the Program for its direct functional purpose, for which purpose to install (reproduce) it on the User’s device(s). The User may install the Program on an unlimited number of devices. When being installed on a device, each copy of the Program will be assigned a unique number, automatically reported to the Right Holder.

3.1.2. To reproduce and distribute the Program for non-commercial purposes (without compensation).

4. Restrictions

4.1. Except as expressly provided for in this License or the applicable law, the User cannot modify, decompile, disassemble, decrypt or perform other actions with the object code of the Program to obtain information on the algorithms implemented in the Program, to create derivative works using the Program, or to otherwise use (allow other use of) the Program, its components, map materials, other images and data stored by the Program on the User’s device, without a written consent of the Right Holder.

4.2. The User does not have the right to reproduce and distribute the Program for commercial purposes (including for a fee), specifically, as part of collections of software products without a written consent of the Right Holder.

4.3. The User does not have the right to distribute the Program in a form other than the form in which the User received it, without a written consent of the Right Holder.

4.4. The Program will be used (and distributed) under the name “Yandex Maps”. The User cannot change and/or delete the Program's name, the copyright notice or other references to the Right Holder.

4.5. If the User launches Program with a plotted route or with indication of other parameters using the functionality of third-party programs more than five times a day, the Right Holder reserves the right to restrict the use of the Program functions for a 24-hour period, beginning from the moment the restriction is imposed. A relevant warning will be displayed on the User's screen, explaining the functionality restriction and the reason thereof. The User shall address the Right Holder to remove such restrictions including through the relevant Program function.

5. Terms of the Use of Individual Functions of the Program

5.1. Certain functions of the Program require an active Internet connection. The User will obtain and pay at his/her discretion for such access in accordance with the terms and rates of his/her service or Internet access provider.

5.2. Map materials, road situation (road traffic) databases and other intellectual property, access to which the Program provides access (hereinafter referred to as the Data) belong to the Right Holder and/or owners of such Data listed in Clause 9 of this License. These materials are exclusively for the User's personal, non-commercial use, within the Program's functionality. When using the Data, the User shall comply with this License, as well as with all terms and conditions as set by the Yandex Maps Service Terms of Use (the “Terms”). Any retrieval, copying, reproduction, processing, distribution, its placement for free access (publication) on the Internet, use in mass media and/or for commercial purposes and any other use of the Data, not expressly allowed in this License or the Terms, is prohibited without a prior written consent of the Right Holder.

5.3. The User is hereby notified that the Program transfers to the Right Holder depersonalized data on the User’s exact location and movement parameters received from a GPS device or on the User’s approximate location identified by an active cell of the telecom provider. This data is used to compile traffic statistics, to provide the Program to the User, and to fulfill obligations under this License.

5.4. All of the User's personal information and any other data related to the use of the Program transmitted in accordance with this License are stored and processed in compliance with the Privacy Policy available at: https://yandex.com.tr/legal/privacy_policy/en/

5.5. The Program enables the User to independently add user data to maps, including signs, marks, textual subscripts, messages, etc. (hereinafter referred to as the User Objects). Adding the User Objects does not modify the source Data, and is for the User's convenience only.

The User entirely bears all risks and liability for the placement, content, legality, accuracy, completeness and reliability of User Objects. The Right Holder is not responsible for designation or description of any User Object and does not confirm nor deny whether it complies with the law or is accurate. The Right Holder reserves the right to delete at its discretion without notice any User Object or a set of User Objects, if the description violates the applicable law and/or the law of the User’s country of residence, contains obscenities, as well as in other cases when designation and/or description of User Objects and/or spreading a link to User Objects breaches the License, the terms of the use of other Right Holder’s services or the documents listed in Clause 1.5 of this License. This also applies to protect the interests of the Right Holder, its users, other third parties. The Right Holder does not guarantee the integrity of User Object data to any extent and/or during any term, including in case of Program or Data updates. All legal and criminal liability arising from User Objects belongs to the User.

5.6. Information on the cost of goods and services at specific map locations is provided by the partners of the Right Holder for reference purposes only. The Right Holder does not guarantee the accuracy, relevance and/or compliance of the indicated prices with the real prices established at the time of the User’s request for the purchase of goods / services at the location of the object, and the Right Holder shall not be hold responsible for the quality of the goods / services purchased. Right Holder shall not be held responsible for the accuracy or currency of this information and advises Users to obtain independent confirmation from the relevant seller or service provider before making any purchases. Right Holder is not an e-commerce platform or seller and is not responsible for order, payment, delivery or return processes.

5.7. The Program enables the User to create routes automatically on maps indicating route options from the point of departure to the point of destination specified by the User (hereinafter referred to as the Routes). Routes are created only for the User's convenience and do not modify the source Data.

The User entirely bears all risks and liability for choosing and following the Route. The Right Holder does not guarantee the accuracy, optimality, relevancy and/or compliance of the Routes with the traffic regulations and is not liable for the User’s Route decisions.

5.8. The Program provides voice activation for search queries by voice dialing and receiving summaries (prompt response) for specific queries. These responses are automatically generated by indexing publicly available information. Therefore, the Right Holder shall not be responsible for the accuracy, relevance, and correctness of such responses.

5.9. The Android, iOS and Symbian versions of the Program are partially based on The Independent JPEG Group's JPEG software, created by the Independent JPEG Group.

5.10. When using the Program, the User may have access to the functions of the Yandex Navi Mobile Program, provided under the Terms of the Yandex Navi Mobile Program License Agreement, which fully apply to the use of the such functions of the Program.

6. Liability under the License

6.1. The Program (including the Data) is provided “as is”. The Right Holder does not guarantee error-free and uninterrupted operation of the Program or its individual components and/or functions, consistency of the Program with specific goals and User’s expectations, reliability, accuracy, completeness and actuality of the Data, and provides no other warranties not expressly stated herein.

6.2. The Right Holder bears no liability for any direct or indirect consequences of any use of or inability to use the Program (including the Data) and/or damage caused to the User and/or third parties as a result of any use, non-use of or inability to use the Program (including the Data) or its individual components and/or functions, including due to possible errors or failures in the Program, except as expressly provided by law. Right Holder shall not be liable for any direct, indirect, incidental, special, or consequential losses resulting from the User using or being unable to use the Program or its functionality.

6.3. All questions and claims regarding the Program or the Data and possible infringement by the Program or the Data of the law and/or third party rights will be submitted via the feedback form available at: https://yandex.com.tr/support/m-maps/tr/troubleshooting.

7. Updates/New Versions of the Program

7.1. This License covers all future updates/new versions of the Program. By installing the update/new version of the Program and/or proceeding to the use of the Program, the User agrees to the terms of this License with respect to corresponding updates/new versions of the Program unless updating/installing a new version of the Program requires any other license agreement. The User agrees to hold the Right Holder harmless for any and all effects that an update/new version of the Program may have on the User and his/her ability to use the Program and the Yandex Maps service, in whole or in part.

8. Change of the Terms of this License

8.1. The Right Holder may amend the terms of this License by publishing a notice of such amendments at the URL specified in this clause. It is User’s responsibility to review this License for any changes, information on changes made in the terms and the current version of the License are published at the page: https://yandex.com.tr/legal/maps_mobile_agreement/. Users are advised to periodically review the current terms before continuing to use the Program. Any changes in the terms of the License Agreement shall come into force from the date of their publication unless otherwise specified in the corresponding publication. By continuing to use the Program, the User agrees to the new or revised License. The User shall discontinue the use of the Program in case of any disagreement with the revised terms of the License.
