License Agreement for the Provision of Rights to Use the Yandex Disk Program
1. General Provisions
1.1. Yandex (as referred in User Agreement for Yandex Services) offers the Internet user (hereinafter referred to as the User) to use the Yandex Disk Program (Entry in the Unified Register of Russian Programs for Electronic Computers and Databases No. 13635 dated May 20, 2022) via remote access at: http://disk.yandex.ru (hereinafter referred to as the "Program").
1.2. In all other respects not provided for herein, the relationship between Yandex and the User in connection with the use of the Program shall be governed by the User Agreement for Yandex Services (https://yandex.com.tr/legal/rules) and the Privacy Policy (https://yandex.com.tr/legal/confidential).
1.3. To use the access rights to the web version of the Program, the User may use the Yandex Disk computer program, and to use the access rights to the Program via mobile devices, the Yandex Disk program for mobile devices (hereinafter referred to as the "Programs"). The use of the Program is governed by the License Agreement for the Use of Desktop Software by Yandex published at: https://yandex.com.tr/legal/desktop_software_agreement/ and the License Agreement for the Use of Yandex Disk Application for Mobile Devices published at: https://yandex.com.tr/legal/disk_mobile_agreement/, respectively.
1.4. By starting to use the access rights to the Program/its individual functional capabilities, the User is considered to have accepted this License Agreement under the terms of a simple non-exclusive license, as well as the terms of all the above documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Program.
1.5. This License Agreement may be amended by Yandex without any special notice, the new version of the License Agreement shall become effective upon posting thereof on the Internet at the address specified in this clause, unless otherwise provided in the new version hereof. The current License Agreement is always available at: https://yandex.com.tr/legal/disk_termsofuse/.
1.6. If Yandex has made any amendments to this License Agreement according to the procedure specified in Clause 1.5 hereof, and the User disagrees with these amendments, the User shall cease using the Program.
1.7. By using the Program, the User gives his/her consent to receive advertising and informative messages. The User may unsubscribe from these advertising messages by using the relevant functions of the Program or by following the instructions specified in a message received.
1.8. Some functionality of the Program may not be available for certain regions. Some functionality may only be available in some languages. Yandex is constantly working to improve the Program, striving to provide the same level of quality in all regions. At the same time, due to differences in legislation, technical limitations and Program development processes, not all functionality of the Program may be available simultaneously in all countries.
2. Use of the Program. Certain Functions of the Program
2.1. Yandex grants the User the right to use the Program via remote access to place files (hereinafter referred to as the "files" or "data") on the disk space of Yandex servers, to store files in the specified space, to synchronize files with the User's devices, to view files, change them, delete them, manage third-party access thereto, implement, by decision of other Users, access to data placed by other Users, as well as otherwise without contradicting the provisions hereof and the documents to which they refer, and the law applicable to the User, including international law. Such rights are inalienable and non-transferable to third parties. The User shall use these capabilities using the Programs or the web interface of the Program.
2.2. The Program offers the User functionality that allows editing images using an editor provided by Aviary, Inc. The User acknowledges and agrees that when using the specified functionality, the image being edited and information about it may be transferred to equipment owned by Aviary, Inc. for the period of editing.
2.3. The Program offers the User functionality that allows creating and editing notes, including creating lists and adding images, as well as storing notes on the disk space of Yandex servers and synchronizing them with the User's devices.
The User has been warned and agrees that these functions are in limited functionality mode. Yandex may make any changes to the structure and algorithms of the functions, suspend its operation, change or terminate the execution of functions without prior notice thereof to the User.
2.4. The Program shall be used via an account created by Yandex. The User has been warned and agrees that its login (user account name), data for First Name, Last Name, Gender and Name at Yandex specified when registering (using) such a login along with the image from its profile page (user icon) and the e-mail address can be displayed and made available for review by third parties, including in the Program event log when the User grants shared access to the data and when the User receives shared access rights to data, when the User leaves comments on the page with data for which shared access rights have been granted, as well as when the User sends invitations and accepts invitations from third parties. If the User has no account in Yandex services and is logged in to Yandex services through its social network account, then along with the User's comment on the page with data for which shared access rights have been granted, his/her image from the account page in the social network will be published, as well as the surname and name specified in the account in the social network and a link to his/her account in the social network, if applicable.
2.5. The Program offers the User a function that allows editing documents using the program provided by New Communication Technology JSC under the terms posted at: https://r7-office.ru/doc/terms_of_service (in Russian) (hereinafter referred to as the R7 Office Service).
2.6. The Program includes a functionality that allows automatic compilation of photos uploaded by the User and stored in the User's disk space (hereinafter referred to as Albums). Albums are formed automatically by processing photos using a special algorithm that does not imply access and viewing of photos by third parties.
2.7. The Program may provide the User with a functionality that allows creating scanned copies of images obtained from the User's device camera using the Yandex Disk mobile application (https://yandex.com.tr/legal/disk_mobile_agreement/) and/or the Yandex Mail mobile application (https://yandex.com.tr/legal/mail_mobile_agreement/), and saving them on such a device and/or on the User's disk space (hereinafter referred to as the "Scanner"). The Scanner is provided using the Yandex Smart Camera function under the terms and conditions specified in the License Agreement for the Use of the Yandex Program for Mobile Devices (https://yandex.com.tr/legal/search_mobile_agreement/).
The User shall be solely liable for the compliance of the content of the images scanned copies obtained using the Scanner with the requirements of applicable laws, in particular international law, including liability to third parties.
2.8. By using the Program, the User agrees that Yandex technical support staff may have access to the attributes of files (name, type, size, etc.) stored by the User on the disk space of Yandex servers for the purpose of processing user requests and providing technical support, while Yandex technical support staff shall have no access to the files’ contents.
2.9. The User may be given the opportunity to create a short video from photos stored on the User's disk space and musical fragments provided by Yandex (hereinafter referred to as the "Memories") using the Yandex Disk mobile application (https://yandex.com.tr/legal/disk_mobile_agreement/).
The User may be able to save the Memories to the device or provide access to other Users. In this case, the User shall be solely liable for ensuring that the contents of the Memories comply with the requirements of the applicable laws, including liability to third parties. Yandex grants the User a non-exclusive right to use the provided musical fragments for use in the Memories by any means not prohibited by law, for non-commercial purposes. The right to use musical fragments as part of the Memories is provided free of charge.
The User may opt out of creating Memories using the features of the Yandex Disk mobile application.
2.10. The User has been notified and agrees that Yandex may, independently or with the participation of partners, study and analyze files stored on Yandex servers in order to search for signs of malicious programs and codes and improve the operation of Yandex anti-virus protection system. In order to protect both the User's equipment and its own equipment, Yandex may delete any files from Yandex servers in cases where signs of malicious programs or codes are found in the said files.
3. Free and Paid Features of the Program
3.1. The User is granted the right to use the standard features of the Program free of charge.
The rights to use the advanced features of the Program may be granted subject to the User (an individual) concluding a paid License Agreement for the Use of Advanced Features of the Yandex Mail Program (Entry in the Unified Register of Russian Programs for Electronic Computers and Databases No. 13555 dated May 20, 2022) for personal and family needs according to the rules published on the Internet at https://yandex.com/legal/promail_offer/, or purchasing a "Disk Pro" paid license under the terms hereof, or subject to the provision of advanced features of the Program in cases stipulated by the document located on the Internet at https://yandex.com/legal/disk_promocode/.
3.2. Having obtained a paid License, the User concludes a license agreement with Yandex (hereinafter referred to as the "Agreement") on the terms and conditions stipulated hereby. Under the Agreement, Yandex shall provide the User with the rights to use the advanced features of the Yandex Disk program via remote access for the term of the license agreement, which shall be equal to the License Period, and the User shall pay the cost of the License. The license granted hereunder is simple and non-exclusive.
For the purposes hereof, the License Period shall mean the period of time (month or year) for which the License is obtained and the corresponding fee is established.
The one-month License Period begins from the date the License is paid and expires on the corresponding date of the calendar month following the License payment date.
The one-year License Period begins from the date the License is paid and expires in the corresponding month and on the corresponding date of the calendar year following the License payment date.
This License applies to the use of the Program throughout the world, where the use of the Program is technologically permitted.
The Yandex Disk License may also be referred to as the "Subscription" in advertising communications and individual elements of the Program interface, and the Yandex Disk program may also be referred to as the "Service" without changing the legal status or content of the license.
3.3. Information on the amount of the License fee, methods of payment, and the License Period, as well as information on other advanced features of the Program available upon purchase of the License, are available at https://360.yandex.com/premium-plans/. This information is part of this License Agreement and the rules of Clause 1.5. hereof shall apply thereto. The User understands and agrees that the list of rights to use the advanced features of the Program, specified at https://360.yandex.com/premium-plans/, may change, including being supplemented/reduced.
When obtaining a License using the Yandex Disk mobile application (https://yandex.com.tr/legal/disk_mobile_agreement/), the amount of the License fee may differ, information on the current fee can be found on the pages of the application store when purchasing the License.
The License cost is not subject to VAT due to the application of the benefit provided for by the legislation of the Russian Federation (Article 149 Clause 2 Subclause 26 of the Tax Code of the Russian Federation).
3.3.1. The User may be granted a discount (without reducing the scope of rights granted to use the Program) on the License cost in accordance with the conditions specified in the document "Discounts Policy " located on the Internet at https://yandex.com/legal/disk_promocode/. In these cases, the final license fee, taking into account the discount, shall be communicated to the User in the Program interface. Yandex shall unilaterally determine the amount of the discount, as well as the term and other conditions for granting the discount.
3.4. The User shall pay license fee in advance. The License shall be granted to the User with all the functions of the Program and in full from the moment the User is granted access to disk space on the Yandex server. No other moment may be interpreted as the moment of fulfilling its obligations by Yandex.
Yandex reserves the right to grant the User access rights to the advanced features of the Program prior to the moment of receiving payment for the License. In this case, Yandex shall be considered to have fulfilled all its obligations at the moment when the User is granted access rights to disk space on the Yandex server.
3.5. When obtaining the License, the User instructs Yandex to collect the License fee (subscription fee) set by Yandex on the day of payment for each License Renewal Period specified by the User when obtaining the License, by way of prepayment, until the User refuses to renew the License for the next License Period at https://360.yandex.com/premium-plans/. Moreover, Yandex may terminate the License in other cases or for other reasons provided for in this License Agreement.
3.6. License is paid with a Linked Card. For the purposes hereof, any bank card linked in the Program interface or in the User’s account on yandex (its affiliates) services (including mobile applications) (including linked during authorization in the Program, before authorization in the Program, or after) is considered a Linked Card. Yandex may debit any of the Linked Cards with the amount equal to the License fee.
Failure by the User to pay the subscription fee for the relevant License Period constitutes a refusal by the User to renew the License. In this case, the User's access rights to advanced features of the Program shall be terminated from the day following the last day of the paid License Period. If the balance of the Linked Card(s) is insufficient to renew the License, Yandex may choose to cancel the User’s access rights to advanced features of the Program from the beginning of unpaid License Period, or not to cancel the User's access to advanced features of the Program until the Linked Card is debited with the subscription fee amount.
3.7. By accepting this License Agreement, the User tasks Yandex with making orders on behalf of the User to debit the User’s account (to which the Linked Card is linked) in favor of Yandex for the License and with sending the said orders to the User’s issuing bank through an acquiring bank.
3.8. The User consents to the regular automatic debiting of his/her account to pay for the License on his/her instructions given as per the procedure provided by this clause hereof and acknowledges that debit orders issued under this clause hereof are those of the User, and the processing center's and the acquiring bank's actions taken to debit the User's account in accordance with this clause hereof are performed with the User's consent.
Automatic debiting under this clause hereof begins subject to the following:
- the User enters all the required details of the Linked Card;
- the automatic Linked Card debiting service is activated as follows: automatically when the first payment is made;
- by clicking the Pay button (or any other similar button), confirming the User's consent to this License Agreemen.
3.9. The User shall independently monitor the information on the License status (paid License Period, License cost, list of available rights to use the advanced features of the Program) in the User’s Account, as well as monitor changes and additions to the License Agreement at https://yandex.com.tr/legal/disk_termsofuse/.
3.10. It is only possible to use the Program with Internet access available. The User shall independently obtain and pay for such access under terms and conditions and as per tariffs of his or her telecom or Internet provider.
3.11. According to the general rule, the User is identified by the details of his or her account. Yandex may use other data to identify the User, including data on the payer, when such identification does not violate rights of the parties concerned, rights of third parties, or applicable laws.
3.12. Where stipulated by the applicable laws, when the License is paid for online or when money received from the said payment is refunded, a cash voucher is sent to the e-mail address specified when invoicing or created when the account the User logged into to make the payment was registered in Yandex ID (https://passport.yandex.com.tr).
3.13. When obtaining a License using the Yandex Disk mobile application (https://yandex.com.tr/legal/disk_mobile_agreement/), payment for the cost of the License selected by the User in the APP STORE is made using the "In App Subscriptions" or "In App Purchases" technology provided by Apple Inc. Automatic renewal of access to the License is carried out under the terms and conditions posted on the Internet at: https://www.apple.com/legal/internet-services/itunes/us/terms.html.
Payment for the cost of the License selected by the User in the Google Play application store is carried out using the "SUBS" or "INAPP" technology provided by Google LLC.

All provisions set forth in Section 3 hereof, including the provisions of Clauses 3.5-3.6 hereof, shall apply to the License acquired using the Yandex Disk mobile application.
3.14. Yandex may limit the amount of disk space intended for storing photos and videos downloaded from the User's mobile device for Users who do not have a valid paid License. If the User exceeds the established restrictions, Yandex may restrict the User's access to the Program, and files downloaded from the User's mobile device may be permanently deleted by Yandex in the manner provided for in Clause 4.8.1. hereof. Until the files are permanently deleted by Yandex, the User may restore access thereto by purchasing a paid License.
4. Limitations to the Use of the Program
4.1. The User shall independently determine how to use the Program and shall be liable for its use. The User shall be liable for the compliance of the content of any file posted by the User with the requirements of applicable laws, in particular international law, including liability to third parties in cases where the User's posting of a file violates the rights and legitimate interests of third parties.
4.2. When using the Program, the User shall refrain from placing such data and from performing such actions, the placing and performance of which is prohibited by the User Agreement for Yandex Services.
The User is hereby acknowledged and agrees that it is prohibited to use the Program and/or individual functions of the Program for unfair purposes, to perform actions aimed at or resulting in the violation of the rights and legitimate interests of third parties.
4.3. Yandex may block access to files posted by the User or delete them, and may also transfer to a third party the data about the User obtained during the provision of the Program, in the following cases:
4.3.1. if Yandex is obligated to do so by virtue of a regulatory act;
4.3.2. if Yandex received from a third party a complaint, claim, inquiry, demand or any other request stating that the file posted infringed third party’s rights or applicable laws;
4.3.3. if posting of the file poses a threat to the normal operability of the Program;
4.3.4. if Yandex received a judicial act or an act issued by a law enforcement body, which obligated Yandex to do so.
4.4. Yandex may delete files posted by the User in the following cases:
4.4.1. The file has been continuously posted in the "Recycle Bin" section of the Program for thirty (30) calendar days.
4.5. Yandex reserves the right to restrict the User's access to the Program (or to certain functions of the Program, if technologically possible) using his/her account or to block the User's account completely in case of repeated violation of this License Agreement or the documents to which they refer.
4.6. Yandex reserves the right to set any rules, limits and restrictions (technical, including limitation of the speed for upload and download, legal, organizational or otherwise), for the use of the Program and may change them at its own discretion, without prior notification of the User. Where this is permitted by the law, the said rules, limits and restrictions may differ for different Users.
4.7. The User may not transfer his/her rights and/or obligations to third parties for a fee or free of charge.
4.8. Yandex reserves the right to restrict the User's access to the Program, as well as delete any or all files and data stored on the User's disk space, in the event of:
4.8.1. the User exceeding the restrictions and/or limits established for the relevant type of use, as well as in the event the User changes the file type in order to circumvent the rules or limits provided for in the Program. Yandex reserves the right to notify the User about the upcoming blocking and deletion of files. In the event of no response and/or adjustment of the limits, Yandex may, after 45 days from the date of the first notice, block the User, and after 90 days from the date of blocking, permanently delete the files and data from the disk space.
4.8.2. the User failing to take any actions to use the capabilities of the Program for two consecutive years. Yandex may warn the User about the upcoming blocking and deletion of files. In the event of no response and/or no actions by the User in the Program, Yandex may, after seven (7) days from the date of the first notice, block the User, and after ninety (90) days from the date of blocking, permanently delete the files and data from the disk space.
4.9. The total volume of incoming data/files uploaded by the User to the Program during every 30 days, starting from the moment of the first upload of files/data to the Program (hereinafter referred to as the Upload Period), regardless of the upload source (direct upload, email attachments, mobile application, etc.) may not exceed the volume available to the User in the Program in the current Upload Period. The file/data, whose upload will lead to exceeding the specified limit, will not be uploaded to the storage in the current Upload Period. The available volume for uploading data/files to the program is communicated to users by publishing the relevant information on the website https://yandex.ru/support/disk/enlarge/disk-space.html#limit
5. Data Distribution. Provision of Shared and Public Access to Files
5.1. The Program provides the User with the ability to distribute data by granting shared access to a file (providing access to a file to several specific users of the Program), or by providing public access to a file (providing access to a file to any Internet users who know the file address in the form of a link).
5.2. Using the capabilities of the Program specified in Clause 5.1. hereof, the User shall act in good faith and refrain from abusing these functions. The User shall also refrain from arranging mass file sharing using the functions of the Program. Yandex may apply rules, limits and restrictions aimed at preventing, restricting and suppressing mass file sharing in accordance with the rules of Clause 4.5. hereof.
6. Liability
6.1. Yandex shall take any reasonable measures and carry out any practicable actions directed at securing the User’s data and supporting operation of the Program. However, the User is aware that the Program may experience technical faults and failures and agrees that Yandex is technically incapable to predict, to notify the User thereof in advance, or to exclude such faults and failures in full. Regardless of reasons and consequences, such faults or failures may not be grounds for sanctions against Yandex.
Yandex shall not be liable for the operation of the R7 Office Service, shall not guarantee the correctness of its operation and shall not be liable for damage caused by the unavailability or impossibility of using the R7 Office Service. In the event of malfunctions being detected or claims or questions arising, the User may contact New Communication Technology JSC at the addresses specified in the terms of use on the Internet page at: https://r7-office.ru/doc/terms_of_service (in Russian).
6.2. Yandex shall have no obligation to moderate, view, edit or control files posted by Users within the Program, and cannot guarantee that files posted by the User within the Program do not violate the provisions of this License Agreement, legal acts or other documents. The User acknowledges and agrees that Yandex shall have no obligation to view any type of data posted and/or distributed through the Program. The User acknowledges and agrees that he/she shall independently assess all the risks associated with the use of data posted in the Program, including the assessment of reliability, completeness, safety, legality or usefulness of such data.
6.3. The User shall use any data obtained using the Program at his/her own risk and shall be solely liable for the possible consequences of using the said data, including any damage that this may cause to the User's computer or mobile device or to third parties, for loss of data, violation of rights or any other harm. Yandex shall not be liable for any damages resulting from the use or inability to use the Program or individual parts/functions thereof by the User, including due to possible errors or malfunctions, except in cases expressly provided for by law.
6.4. Regardless of the User's or User's equipment location, the laws of the Russian Federation shall apply to all relations with regard to the use of the Program, and any claims or lawsuits arising from the use of the Program shall be filed and considered in court at the location of Yandex.
6.5. Yandex may provide the User with a translation of this License Agreement from Russian into other languages, however, in the event of a conflict between the Russian version of the License Agreement and its translation, the Russian version shall prevail.
6.6. All questions, queries and claims related to the use of / inability to use the Program and possible violations of laws and/or third-party rights by the Program shall be sent via the feedback form at: https://yandex.com.tr/support/abuse/troubleshooting/disk/list.html.
