Yandex.Travel Terms of Use
1. General Provisions
1.1. YANDEX LLC ("Yandex") offers Yandex.Travel service available at https://travel.yandex.ru, https://avia.yandex.ru, https://trains.yandex.ru, https://yandex.ru/bus ("Service") to Internet users ("Users") under the terms and conditions set out below ("Terms and Conditions").
1.2. These Terms and Conditions are supplementary to Yandex services user agreement related to the procedure of the use of the Service. In all matters not covered in these Terms and Conditions, the relations between Yandex and the User with respect to the use of Service are regulated by Yandex services user agreement (https://yandex.com.tr/legal/rules), License to Use Yandex Search Engine (https://yandex.com.tr/legal/termsofuse), and Privacy Policy (https://yandex.com.tr/legal/confidential).
1.3. When starting to use the Service, its functions and Systems, the User is deemed to have accepted the Terms and Conditions as well as conditions of all the documents specified in the Terms and Conditions, in full, with no options or exceptions. In case of disagreement with any of the provisions in the aforementioned documents, the User shall not use the Service.
1.4. Yandex may modify these Terms and Conditions without any special notice. A revised version of the Terms and Conditions will be effective on the date when it is posted on the Internet at the URL as specified in this paragraph, unless otherwise provided by a newer version of the Terms and Conditions. The current version of the Terms and Conditions is always available at: https://yandex.ru/legal/travel_termsofuse.
1.5. The User shall stop using the Service in case of disagreement with any amendments to the Terms and Conditions made by Yandex in the manner prescribed by par. 1.4. hereof.
1.6. The Service provides the User with a free functionality to access and/or search for the following information:
- on hotels and other means of accommodation ("Hotels") and Yandex partners' offers for booking and payment thereof ("Hotels System");
- on Yandex partners' offers to purchase air tickets ("Air Tickets System");
- on Yandex partners' offers to purchase train e-tickets ("Railway Tickets System");
- on Yandex partners' offers to purchase e-tickets for road transport (buses) providing scheduled, on-demand, and/or other services ("Buses System");
(hereinafter jointly referred to as "Systems").
1.7. All currently existing Service functions, as well as any development thereof and/or newly added services are subject to these Terms and Conditions
1.8. By using the Service, the User gives its consent to receive advertising messages. The User may refuse to receive advertising messages by using the relevant functionality of the Service or following instructions specified in the received advertising message.
1.9. The User may contact Yandex support for assistance in using the Service. Yandex may contact the User at the phone number specified by the User. In these cases, the Yandex support service specialist acts on behalf of and under instructions of the User, the rights and obligations under these Terms arise directly for the User. Yandex informs about the availability of such an opportunity on the Service website with the corresponding telephone number of the support service. Yandex support service in these Terms means both the internal service and Yandex specialists, as well as specialists engaged by Yandex on a contractual basis for the purposes of Yandex support service. All conversations of the User with Yandex support specialists can be recorded in order to control quality and improve service.
2. Use of the Service
2.1. Any information used in the Service is intended solely for non-commercial use. At the same time, any duplication, reproduction, processing, distribution, or communication of the data to the public (posting) on the Internet, any use in the mass media and/or for commercial purposes with no prior written permission of Yandex is prohibited, except as otherwise expressly provided hereby, by provisions of the documents referred to herein, or the terms of use of other Yandex services.
2.2. Yandex reserves the right at its sole discretion to limit the User’s access to the Service (or its particular features, if technologically applicable) with the use of the User’s account, or completely lock the User’s account in case of a repeated breach of the Terms and Conditions, as well as take remedial actions toward the User in order to comply with the law or the rights and legitimate interests of third parties.
2.4. By using the Service, the User grants consent for Yandex and its affiliates to process the User's personal information as defined in the Privacy Policy (https://yandex.com.tr/legal/confidential) and/or personal details of persons the User specified for Yandex to provide the Service and the Systems, including the transfer (including across borders) by Yandex of personal information of the User and/or the persons the User specified for the said purposes to Yandex partners and the receipt of such information from the said persons for the same purposes and for the purposes prescribed by law, including the purposes of executing rights and the legitimate interests pursued by the Yandex or by the third parties. Yandex only transfers personal information of the User and/or persons the User specified that is needed for the above purpose. Yandex processes the User’s personal information and/or personal information of persons the User specified, and any other information the User uploaded, transferred, and received via the Service as specified in the Privacy Policy of Yandex posted online at https://yandex.com.tr/legal/confidential, insofar as it does not conflict with these Terms and Conditions.
2.5. The User may have access to the save option for personal information of the User and/or the persons the User specified and other information they previously entered in the booking form when using the Service, as well as the subsequent auto-fill option for booking forms in the Service and other services of Yandex and its affiliates supporting these options. In this regard, when booking, the User grants consent for Yandex to receive (inter alia, receive information from third parties) and process such information for the said purpose and as specified in the Privacy Policy (https://yandex.com.tr/legal/confidential). Yandex does not guarantee that auto-fill results are accurate and complete and is not responsible for incorrect booking data the User indicated.
2.6. The User is hereby notified, understands and agrees that, when the Service is used to provide the User with functions of the Service, Yandex automatically receives the following information: the User's device operating system, browser version and ID, Service functions statistics, device location (if applicable), search history, tourism services search parameters, and any other technical information.
2.7. When placing information within the Service, the User automatically gratuitously, unconditionally and irrevocably grants to Yandex the non-exclusive right to use such information worldwide and at all times as Yandex thinks fit, including, but not limited to any reproduction, copying, selection, systematization, transformation, change, editing, translation, publication, distribution of such information fully or partially by any legal means. Also, when placing information within the Service, the User confirms that it has the relevant rights and authority to grant the above non-exclusive right to Yandex. If the User is not entitled to provide the above non-exclusive right to Yandex, it shall refrain from posting such information in the Service. Yandex may use this information both with and without the author's name specified (the name of the User that posted the information specified in its account in the Service is used as the author's name). Yandex may transfer the rights specified in this paragraph to third parties.
2.8. Yandex may at any time delete or edit any information the User posted within the Service without notice to the User and without giving any reasons. Such deletion (editing) can be justified by posting the information that violates the User Agreement for Yandex Services, the Terms and Conditions, or provisions of any of the documents they refer to.
3. Particular Service Systems
3.1. Hotels System
3.1.1. Hotels can be booked and accommodation can be paid directly through Yandex partners' websites. Yandex is not responsible for financial and any other transactions effected on the websites of the partners (or other third parties in respect of booking and paying for accommodation in the Hotels), and for any consequences of booking and paying for accommodation in the Hotels on these websites.
3.1.2. The Hotels can be booked and accommodation can be paid through Yandex resources. In this case, the Hotels are booked as per the terms set forth in the Hotels Booking Terms and Conditions on Yandex.Travel publicly available online at: https://yandex.ru/legal/hotels_booking_conditions.
3.2. Air Tickets System
3.2.1. The Air Tickets System in the Service uses information provided by Yandex partners. Such information is accompanied by a reference to the Yandex partner (inter alia, by placing its logotype, and/or trade name, and/or a link to the partner's website) that provided the information; the User can find more details about the Yandex partner on the Yandex partner's website.
3.2.2. The air tickets are processed and paid for directly through Yandex partners’ websites. The air tickets are booked either on Yandex partners' websites or, if functionally possible, in Yandex partners' systems, but using the data from the booking form (widget) available on the Air Tickets System in the Service that enables interaction between the User and Yandex partners' websites and/or booking systems. Yandex is not responsible for financial and any other transaction effected on such websites or through Yandex partners' systems, inter alia, with the booking form (widget) in the Air Tickets System in the Service, and for any consequences of purchasing tickets as described above.
3.2.3. The information about the flight, terms and conditions of the contract of carriage and services on board an aircraft, inter alia, about the aircraft type, carrier, schedule, route, departure/arrival time, departure/arrival airport, flight delay (cancellation), the carrier's rules of passengers and baggage air service is provided for reference only and should be verified by the User with the Yandex partner or the respective carrier. Yandex is not responsible for the relevance of such information.
3.3. Railway Tickets System
3.3.1. The train e-tickets are purchased as per the terms and conditions set forth in the Train E-Tickets Purchase Conditions publicly available online at: https://yandex.ru/legal/train_tickets_booking_conditions.
3.4. Buses System
3.4.1. The Buses System in the Service uses information provided by Yandex partners. Such information is accompanied by a reference to a Yandex partner or a carrier that provided such information to the Yandex partner, when the User is booking a ticket, and on other pages of the Service and/or the Buses System.
3.4.2. The Buses System enables the User to book and purchase tickets directly from the Yandex partner / carrier via the Service software and Yandex partners' software (including API). Yandex does not control Yandex partners' software and/or software available to (used by) Yandex partners, therefore it is not responsible for correct ticket arrangement by Yandex partners and the availability of necessary and sufficient information in the tickets as prescribed by the Russian laws.
3.4.3. As per paragraph 3.4 hereof, tickets mean e-tickets for road transport (buses) providing scheduled, on-demand, and (or) other services.
3.4.4. With the Yandex account, the User can access the following functions of the Buses System:
- save and view previously purchased tickets in My Tickets section of the Service;
- save, change and delete passenger data the User entered to book and purchase a ticket.
3.4.5. Yandex is not a carrier. The User relations in respect of transportation services are governed by a contract between the User and the carrier, the terms and conditions whereof are set forth by the carrier and/or the seller (Yandex partner) in a ticket or in electronic form as the Yandex partner thinks fit. If the name of the carrier is not specified in the ticket, the User shall contact the Yandex partner specified in the ticket in advance to clarify information on the carrier. Notification of the User about changes in the terms of the contract of carriage may occur by sending the User relevant information and / or by providing the User with a link to a resource containing relevant information; in the latter case, the User must address to this resource in advance to clarify the relevant information on transportation.
3.4.6. The bus e-tickets are booked and purchased as per the terms and conditions set forth in the E-Tickets Booking and Purchase Conditions on Yandex.Buses publicly available online at: https://yandex.ru/legal/bus_tickets_booking_conditions.
4. No Warranties, Limitation of Liability
4.1. Yandex provides the Service "as is". Yandex provides no warranties of fitness of the Service (or any information placed within the Service) for purposes and expectations of the User, of trouble- and error-free operation of the Service in general and its certain functions and Systems in particular, Yandex may at any time change the Systems and functions the Service provides, fully or partially.
4.2. Yandex is not responsible and shall not indemnify against any damage, direct or indirect, the User or third parties suffered from the use or unavailability of the Service and information placed within the Service. The User is aware and agrees that it shall independently assess all the risks associated with the use of information placed within the Service, including its reliability, completeness, safety, legality, or usefulness.
4.3. Yandex is not responsible for the accessibility of resources, links whereto are available on the Service, inter alia, for the accessibility of the partners' websites and for the compliance of such resources with legal requirements.
4.4. Yandex has no obligation to moderate, review, and edit information the Users post within the Service and cannot guarantee that information the User posted does not violate the provisions of the Terms and Conditions, the documents they refer to, or applicable laws.
4.5. The User is solely responsible to third parties for its actions taken to create and place information within the Service, inter alia, for the compliance of the User information content with the requirements of the current laws. The User understands and agrees that the information it posted should not violate copyright, rights to trademarks, means of individualization and/or rights to other intellectual property items owned by third parties. The User undertakes to settle all third-party claims arising from creating and placing information in the Service, independently and at own expense.
4.6. Except as expressly stipulated by the laws, Yandex is not responsible for the relevance of information Yandex partners provide, including information on the availability and cost of the Hotels booking and ticket (air tickets) purchase and information on transportation, for which the User books and purchases tickets (air tickets).
4.7. Yandex is responsible neither for any financial or other transactions effected on Yandex partners' websites nor for any consequences of the User booking the Hotels and purchasing tickets (air tickets) on the above websites.
4.8. Yandex is not responsible for information/services provided by the partners. Yandex is not responsible for the unavailability of the services the User purchased from Yandex partners and/or on Yandex resources, inter alia, due to force majeure events, bankruptcy, or the inability of a Yandex partner or a person that actually provides services to the User to continue operations, illness of the User, missing User’s documents that confirm the right to use the purchased services or visit certain countries and/or regions, unless otherwise stipulated by the applicable laws or a respective services contract.
